Terms of Use - ZipZest
Terms of Use – Customers
These general terms of use (the "Customer Terms") apply to anyone who visits a restaurant's online shop or QR menu on ZipZest, places an order through it or creates a customer account. The terms that apply to restaurants using ZipZest are available in the Restaurant Terms.
1. In short
- You order from the restaurant, not from ZipZest. The restaurant is your seller: it sets its prices, prepares your order, handles delivery or pickup and deals with your complaints.
- ZipZest only provides the technical tool that lets the restaurant sell online.
- Online payments go directly to the restaurant, through our payment provider Stripe. ZipZest takes no commission on your order.
2. Who we are
The ZipZest platform is operated by The Design Clinic Junod, Sous-l'Église 6, 2043 Boudevilliers, Switzerland ("ZipZest", "we", "us"). Contact: [email protected].
Each restaurant is a business independent of ZipZest. Its name and contact details are shown in its shop.
3. Acceptance
By placing an order or creating an account, you accept these Customer Terms. You also acknowledge our Customer Privacy Policy. The restaurant may apply additional specific conditions, which will then be shown to you in its shop.
4. Placing an order
4.1 In the restaurant's shop, you choose your products and options, how you want to receive your order (pickup or delivery) and when (as soon as possible or in a given time slot), from the options the restaurant offers.
4.2 Delivery is only available within the zones set by the restaurant. A minimum order amount and delivery fees may apply; they are shown before you confirm.
4.3 You provide your details (name, phone, email, and delivery address if needed). You are responsible for their accuracy: a wrong address or number may prevent delivery.
4.4 Before confirming, you can review and correct your order. By clicking the order button, you make a binding offer to buy from the restaurant.
4.5 The sales contract is concluded between you and the restaurant when the restaurant confirms the order (manually or automatically). You receive a confirmation by email and can follow your order's status via the link sent to you.
4.6 The restaurant may decline or cancel an order, for example if a product is no longer available, if the address is outside the delivery zone or if it is overloaded. It will inform you and refund any amount already paid.
5. Prices
Prices are set by the restaurant in Swiss francs (CHF), including VAT. The total price, including any delivery fees and discounts, is shown to you before you confirm the order. Discount codes are issued by the restaurant under its own conditions.
6. Payment
6.1 The available payment methods are chosen by the restaurant and shown when you order.
6.2 Online payment (card, TWINT, Apple Pay, Google Pay, etc.): it is processed by Stripe on a secure payment page and paid directly to the restaurant. ZipZest has no access to your card details. The amount is charged when you place the order.
6.3 Payment on pickup or delivery (cash, TWINT, card): you pay the restaurant or its delivery person directly.
7. Delivery and pickup
7.1 Delivery is carried out by the restaurant itself or by a delivery provider it has chosen. The times shown are estimates; delays may occur (busy periods, traffic, weather).
7.2 Please be present and reachable at the address and time given. For pickup, come to the restaurant at the agreed time. If you are absent or cannot be reached, the restaurant may treat the order as delivered or handed over and is not required to refund it.
8. Allergens, alcohol and product quality
8.1 Product information (descriptions, photos, ingredients, allergens) is provided by the restaurant, which is solely responsible for it. Photos are for illustration only. If you have an allergy or intolerance, contact the restaurant before ordering: you can also mention it in the "Notes" field, but this does not replace checking directly.
8.2 The sale of alcohol is subject to age limits (16 for beer and wine, 18 for spirits). The restaurant or its delivery person may ask for ID and refuse to hand over alcohol.
9. Cancellation, complaints and refunds
9.1 Swiss law does not provide a right of withdrawal for online purchases; moreover, perishable food prepared to order cannot be returned. A confirmed order can therefore generally no longer be cancelled by you, unless the restaurant agrees.
9.2 For any complaint (missing or incorrect product, delay, quality issue), contact the restaurant directly as soon as possible. Only the restaurant can decide on a goodwill gesture or a refund.
9.3 Refunds are made by the restaurant, usually to the payment method used. For online payments, the time it takes for the refund to appear depends on your bank or card issuer.
9.4 If you cannot reach the restaurant, you can write to us at [email protected]; we will pass your request on to the restaurant, but cannot decide on its behalf.
10. Customer account
10.1 You can order without an account. If you wish, you can create a ZipZest customer account when ordering or from the sign-up page. This account lets you find your details and your order history across all restaurants using ZipZest, and publish reviews.
10.2 You must be at least 16 years old to create an account. You are responsible for keeping your password confidential and for activity on your account.
10.3 You can change your details and delete your account at any time from your profile. Deleting your account does not erase orders already passed on to restaurants, which must keep them for their own obligations (in particular accounting).
10.4 We may suspend or delete an account in case of abusive use or use contrary to these Terms.
11. Reviews
11.1 If you have ordered from a restaurant and are logged in to your account, you can publish a review (rating and comment). Your review is shown publicly on the restaurant's page with your account name. The restaurant may reply publicly.
11.2 Your review must reflect your genuine experience, be respectful and must not contain abusive, discriminatory or defamatory statements, third parties' personal data or advertising.
11.3 By publishing a review, you grant ZipZest and the restaurant a free, non-exclusive right to display it on the Platform. ZipZest may remove any review that breaches these rules or the law.
12. Proper use
You agree not to place fake orders, not to use someone else's identity or payment methods, not to misuse discount codes and not to attempt to disrupt or circumvent the Platform. Any fraud may be prosecuted.
13. Liability
13.1 The restaurant is solely responsible for the products sold, their quality and compliance, allergen information, and for delivery or pickup and the performance of the order.
13.2 ZipZest does its best to keep the Platform running smoothly, but cannot guarantee that it will always be available and error-free. ZipZest is liable for damage it causes intentionally or through gross negligence; to the extent permitted by law, any other liability of ZipZest is excluded. Mandatory statutory provisions, in particular on product liability or injury to life or health, remain reserved.
14. Intellectual property
The ZipZest platform, its design and its trademarks belong to ZipZest. The menus, photos, logos and content of each shop belong to the restaurant concerned. Any reproduction without permission is prohibited.
15. Data protection
Your personal data is processed by the restaurant you order from and by ZipZest, as described in the Customer Privacy Policy.
16. Changes to these Terms
We may change these Terms. The version that applies to an order is the one in force when the order is placed. If you have an account, we will inform you of material changes by email.
17. Governing law and jurisdiction
These Terms are governed by Swiss law. The courts at ZipZest's registered office have jurisdiction, subject to the mandatory places of jurisdiction provided by law for consumers, who may in particular bring proceedings before the court of their place of residence. Disputes relating to an order are to be settled with the restaurant concerned.
